By accessing or using SpeakWith, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our platform. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

You must be at least 18 years of age to use SpeakWith. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these terms. We reserve the right to request age verification at any time and to terminate accounts of users who do not meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating your account. You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

All AI characters on SpeakWith are entirely fictional and are not real people. AI responses are generated by machine learning models and should not be considered factual, professional, medical, legal, or financial advice. SpeakWith does not guarantee the accuracy, completeness, or reliability of any AI-generated content. Interactions with AI characters are for entertainment purposes only. Users acknowledge that AI characters do not have consciousness, emotions, or personal experiences.

You agree not to use SpeakWith to: generate, share, or promote content depicting violence, self-harm, or harm to others; create or distribute hate speech, discriminatory content, or harassment; produce illegal content or content that violates any applicable laws; generate non-consensual sexual content or content involving minors; attempt to manipulate AI systems to bypass safety filters; impersonate real people without their consent; use the platform for spam, phishing, or malicious purposes; reverse-engineer, decompile, or attempt to extract our AI models. Violation of these rules may result in immediate account termination without refund.

Stars are virtual currency used within SpeakWith to unlock premium features and content. Stars are non-refundable once purchased, except where required by applicable law. Stars have no real-world monetary value and cannot be exchanged for cash. We reserve the right to modify the pricing, availability, and functionality of Stars at any time. Unused Stars do not expire but may be forfeited upon account termination for Terms violations.

Premium subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase. Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period. We reserve the right to change subscription pricing with reasonable notice.

SpeakWith and all associated content, features, and functionality are owned by SpeakWith and are protected by intellectual property laws. AI characters created by SpeakWith remain our intellectual property. Characters you create using our tools may be shared on the platform subject to our content guidelines. You retain ownership of the text content you input, but grant us a license to use it for service improvement. You may not copy, modify, or distribute our platform content without explicit permission.

By creating characters or content on SpeakWith, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on our platform. You represent that you have the right to share any content you create. We reserve the right to remove any user-generated content that violates these terms.

We may suspend or terminate your account at our sole discretion if you violate these Terms of Service. Upon termination: access to your account will be immediately revoked; any remaining Stars or active subscriptions may be forfeited if termination is due to Terms violations; you may request your data in accordance with our Privacy Policy. You may delete your account at any time through account settings.

SpeakWith is provided "as is" and "as available" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to SpeakWith in the 12 months preceding the claim. We are not responsible for any decisions you make based on AI-generated content. Service availability is not guaranteed, and we may experience downtime for maintenance or unforeseen issues.

You agree to indemnify and hold harmless SpeakWith, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of the platform or violation of these terms.

These Terms of Service shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class-action lawsuits against SpeakWith.

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on our platform at least 30 days before taking effect. Your continued use of SpeakWith after changes take effect constitutes acceptance of the updated terms.
